Official Contest Rules for “89X World Tour Destination 15: Weezer in Tokyo, Japan!

1. HOW TO ENTER: NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. To enter “89X World Tour Destination 15: Weezer in Tokyo, Japan!” contest (the “Contest”) on CIMX FM, starting August 18, 2008 and ending September 3, 2008 entrants must listen to 89X for during the 8 am, 11 am, 5 pm, and 8 pm Eastern Time (“ET”). Then when they hear the “cue to call”, entrants should call (313) 298-7999 or (519) 792-5000. Calls may be made only to the designated phone number. The entrant whose call is the 10th call answered by a CIMX FM employee and who otherwise meets the requirements set forth in these official rules, will be the winner of an 89X baseball hat (the “Prize”) and a limited edition 89X World Tour Destination 15 lanyard. All potential winners will be notified at the time of their winning call that they are the winner. Qualification is subject to FULL phone call completion, and the verification of the caller’s name, address, home phone number, work/cell phone number, all of which must be provided prior to completion of the call. Each prize winner will also be entered into a random draw for the Grand Prize described below. The Grand Prize drawing will be held at or around 9:00 AM ET on September 8, 2008. The Grand Prize potential winner will be notified by telephone. If the potential winner cannot be reached after three attempts, or if the potential winner is found to be ineligible, an alternate potential winner will be selected. Qualifiers that did not win the Grand Prize will not be notified that they did not win. Limit one entry per person. All contests on CIMX are void where prohibited or restricted by law.

2. ELIGIBILITY: The contest is open to legal residents of Ontario, Michigan, Ohio, and Pennsylvania of or over the age of 13 as of August 18, 2008. The winner of the Grand Prize must be of or over the age of 21 as of August 18, 2008. Employees of CIMX, and their respective partners, parent companies, divisions, subsidiaries, affiliates, trustees, licensees, are not eligible to participate in the Contest and/or win any prize. Additionally, relatives of and those living in the same household of such employees are not eligible to win. For the purposes of all contests, relatives are defined as mother, father, in-laws, grandmother, grandfather, brother, sister, children and grandchildren. Those who have won any prize from CIMX within the last 30 days are also ineligible to enter the contest or win a prize. Once the 30 days have expired, they will then become eligible to win a prize again. CIMX is has sole discretion of any potential winner’s eligibility.

3. WINNERS/PRIZES: Prize: An 89X baseball hat and a limited edition 89X World Tour Destination 15 lanyard

Grand Prize:

1. Roundtrip coach airfare for two to Tokyo, Japan from Detroit, MI

2. 2 tickets to see Weezer LIVE on 09/12/08 at Zepp Tokyo OR 09/15/08 at Yoyogi Gym (exact show and seats at the sole discretion of CIMX)

3. 3 nights (double occupancy standard accommodation) Hotel (chosen at the discretion of CIMX)

Grand Prize Winner will have the option of receiving the grand prize package or a one-time cash payment of $1000 USD or $1000 CND depending on country of residence. No cash equivalent for the prizes. No transfer or prize substitution is allowed. CIMX reserve the right to substitute a prize for a prize of equal or greater value. If the Grand Prize winner chooses not to attend an event, or go on the trip, once the option is chosen CIMX will not substitute another prize. All applicable federal, state and local taxes, including, without limitation, excise tax (including sales tax). Ground transportation (including transportation to and from the Grand Prize winner’s residence to the Detroit, MI airport, spending money, meals and any other items not set out herein, are the Grand Prize and Grand Prize winner’s guest’s sole responsibility. Winners and the Grand Prize winner’s guest may be required to sign an affidavit of eligibility and liability/publicity release, as and where instructed by CIMX, or the prize may be forfeited. Winner and winner’s guest may also be required to provide his or her United States social security number or Canadian social insurance number for tax purposes. The Grand Prize winner and his/her guest must be in possession of valid passport and proof of citizenship satisfactory to applicable customs and immigration officials. The Grand Prize winner and his/her guest must depart from and return to the same gateway. The approximate value of the Grand Prize is $5,000 and the approximate value of the Prize is $12.00 USD. If winner documentation is returned as undeliverable, a prize may be forfeited. If prize is returned as undeliverable or not picked up within 30 days, prize will be forfeited. Decisions made by CIMX are final in all matters, including interpretation of these official rules and awarding of a prize.

4. ODDS OF WINNING: The odds of winning a prize depend upon the number of entrants.

5. LIMITATION ON LIABILITY / DISCLAIMER / OTHER REQUIREMENTS: All entrants, as a condition of entry, agree to be bound by these official rules and the decisions of CIMX. Except where prohibited by law, by entering this Contest, each winner consents to the use of his/her name, voice, picture, likeness and biographical data and/or any other information contained in his/her entry in advertising, promotional and marketing materials by CIMX in all media now known or hereafter discovered without additional compensation, notice, review or approval. All entrants further acknowledge that if they are chosen as a winner, certain of their personally identifying information will not disclosed to third parties but will be as required by law, including, without limitation, on a winners list. If the contest is not capable of running as planned, including, without limitation, because of human error, bugs, tampering, unauthorized intervention, fraud, technical failure or other cause beyond the control of CIMX which corrupts or threatens to corrupt or adversely affects the administration, security, fairness, integrity or proper conduct of the Contest, CIMX reserves the right, in its sole discretion, to cancel, suspend and/or modify this Contest and CIMX can conduct an alternate sweepstakes in order to award the prize, in its sole discretion. Online listeners to the CIMX web stream may experience a reception delay of up to two minutes. Listening to CIMX’s over-the-air broadcast is the best way to participate in the on-air portion of any contest.

PARTICIPANTS AGREE TO RELEASE CIMX FROM ANY AND ALL LIABILITY, CLAIMS OR ACTIONS OF ANY KIND WHATSOEVER FOR INJURIES, DEATH, DISABILITY, ATTORNEYS’ FEES, COSTS OF LITIGATION AND SETTLEMENT AS WELL AS DAMAGES OR LOSSES TO PERSONS AND PROPERTY THAT MAY BE SUSTAINED IN CONNECTION WITH THE RECEIPT, OWNERSHIP OR USE OF THE PRIZE, PARTICIPATING IN ANY CONTEST OR WHILE TRAVELING TO AND/OR FROM A LOCATION TO OBTAIN OR USE THE PRIZE OR PARTICIPATE IN A CONTEST. CIMX DOES NOT MAKE ANY WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE USE OF THE PRIZE INCLUDING, WITHOUT LIMITATION, QUALITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ANY AUTOMOBILE WARRANTIES IMPOSED BY LAW, WHETHER NOW KNOWN OR HEREAFTER ENACTED.

CIMX, is not responsible for technical, hardware, software, cable, or telephone malfunctions of any kind, lost or unavailable network or telephone connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by CIMX, Sponsor or the Sponsor Affiliates, the user, or by any of the equipment or programming associated with or utilized in any contest or by any human error which may occur in the processing of the entries or calls in or administration of the Contest which may limit an entrant's or caller’s ability to participate. Further, CIMX, Sponsor or the Sponsor Affiliates are not responsible for any lost, late, illegible, misdirected, mutilated, incomplete or postage-due mail. Any person who supplies false information, enters by fraudulent means, or is otherwise determined to be in violation of these official rules in an attempt to obtain the prize will forfeit the prize won and may be prosecuted to the fullest extent of the law. Each entrant agrees not to knowingly: damage or cause interruption of the Contest; prevent others from using the Contest; or obtain or modify another’s information without their consent. Submission of an entry or an attempt to call in for a chance to win is acknowledgment of and agreement to be bound by all terms and conditions of these official rules.
